01 · DEFINITIONWhat Double Taxation Agreement (DTA) means
A Double Taxation Agreement (also called a Bilateral Tax Treaty or Tax Treaty) is a legal agreement between two countries specifying which nation has primary taxation rights over specific income types, preventing the same income from being taxed by both jurisdictions simultaneously.
DTAs typically prioritize the country where income is earned (source country) for business income, while giving the residency country priority for employment income. Key provisions include: permanent establishment rules (when operating in a country creates taxable presence), withholding tax rates on dividends, interest, and royalties, tie-breaker rules for dual-resident individuals, and mutual agreement procedures for disputes.
For entrepreneurs operating internationally, DTAs are essential infrastructure — they prevent double taxation on business profits, reduce withholding taxes on cross-border payments, and define which jurisdiction can legitimately tax each income stream. The OECD Model Tax Convention forms the basis for most modern DTAs, though bilateral negotiations produce significant variations. Most developed nations maintain DTA networks covering 50 to 100+ countries. Where no DTA exists between your residency country and a source country, unilateral relief mechanisms (tax credits or exemptions) may partially mitigate double taxation.
